Terms of Service
The agreement between you and Pixel Online when you use any of our products.

Who this agreement covers
This policy applies to Pixel Online (PIXEL ONLINE, ABN 34 297 542 192) and to each of the following products and their websites (together, the "Services"):
- wSMTP — wsmtp.com
- AdSwn — adswn.com
It also applies to any product we add to our portfolio in the future. The current list is always published at pixelonline.com.au.
By creating an account on, subscribing to, or using any of the Services, you agree to these terms. An individual product may publish supplementary terms on its own website; where they conflict, the product's terms apply to that product.
Your account
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- You must be at least 18 years old, or use the Services under the supervision of someone who is.
- One person or legal entity may not create multiple accounts to circumvent plan limits.
Acceptable use
You agree not to use any of the Services to:
- send spam or unsolicited bulk messages;
- infringe the rights of others or break any applicable law;
- distribute malware or attempt to gain unauthorised access to any system;
- resell or white-label a Service without our written permission; or
- impose an unreasonable load on our infrastructure or interfere with other customers' use.
We may suspend or terminate accounts that breach these rules. Where practical, we will warn you and give you a chance to remedy the breach first.
Subscriptions and billing
Paid plans are billed in advance through Stripe on a recurring basis and renew automatically until cancelled. Billing, cancellation, and refunds are covered in detail in our Refunds & Payments Policy, which forms part of this agreement. Charges appear on your card statement under the descriptor PIXELONLINE*.
Your data
Content and configuration you create in a Service belong to you. You grant us the licence needed to host and process that data solely to provide the Service. Our handling of personal information is described in the Privacy Policy.
Service availability and changes
We work to keep the Services available and performant, but they are provided on an "as is" and "as available" basis and we do not guarantee uninterrupted operation. We may change or retire features; if we discontinue a paid Service entirely, we will give you at least 30 days' notice and refund any prepaid, unused portion of your subscription.
Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other statute that cannot lawfully be excluded.
Subject to that, our total liability arising out of or in connection with a Service is limited to the amount you paid us for that Service in the 12 months before the claim arose, and we are not liable for indirect or consequential loss, including lost profits or lost data.
Termination
You may close your account at any time from within the relevant product or by emailing [email protected]. We may terminate this agreement if you materially breach it and do not remedy the breach within 14 days of notice.
Governing law
These terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the Australian courts.
